of trade association of Sdružení zahradnických center s.r.o., TIN 04682785, registered oﬃce Prague 6 - Veleslavín, Na Dračkách 405/49, postal code 162 00 (hereinafter referred to as "Provider"), for the purchase of services on the website of www.igca2018.cz (hereinafter the "Portal"), valid from 15 May, 2017 (hereinafter referred to as the "Terms and Conditions").
These Terms and Conditions of the Provider govern the process of concluding the Contract and the reciprocal rights and obligations of the parties arising from a provision of accompanying services for participants of the Congress of the International Association of Garden Centers (IGCA) (hereinafter the "Congress") by the Provider as a co-organizer of the Congress through their his Website.
These Terms and Conditions, as well as the Congress and Services, are exclusively intended for entrepreneurs invited to the Congress (hereinafter the "Customer") and not for consumers or the general public. A customer who is a consumer is not entitled to use the Website to purchase services, but may contact the Provider at their address or email address to request an individual oﬀer of the services.
The Provider offers the Services to the Customers as participants of the Congress, consisting mainly of:
a) Providing accommodation during the Congress;
b) Providing transport within the Congress;
c) Providing food at the Congress;
(Hereinafter the “Services”). Services may also be provided by Customers to third parties through which the Provider ensures the provision thereof.
The provisions of these Terms and Conditions form an integral part of the Provision of Services Contract (hereinafter “Contract").
In order to conclude the Contract within the purchasing process, the Customer shall ﬁrst select a Service on the Website which he/she wishes to order and the required range thereof, all according to the Provider's current oﬀer available on the Website. This step is conﬁrmed by pressing the "ADD TO CART" button. VAT is included in the prices.
As soon as the Customer carries out the selection of all ordered Services he/she intends to purchase by the above mentioned procedure, he/she proceeds in the purchase process by pressing the "GO TO ORDER" button. Subsequently, the Customer will ﬁll in his/her data, email address, and other information necessary for the provision of the Services. Then he/she will be presented with a summary of his/her order, entered data, ordered Services, and the total price that the Customer may send by pressing the "COMPLETE ORDER" button. The condition for completing the order is to accept these Terms and Conditions, the processing of personal data, and the statement "I am not a consumer."
Subsequently, the Customer will be redirected to a secured internet payment gateway of Komerční banka to make a payment for the Services by a bank transfer using a payment card following the instructions given there. The Customer is obliged to familiarize himself/herself with the relevant business terms and conditions governing the use of the payment gateway before using it. No other form of payment is allowed.
The Contract between the Provider and a Customer is created by paying the price of the Services by means of a payment card. Conclusion of the Contract together with the summary of the order and the payment conﬁrmation shall be sent by the Provider to the Customer at the email address speciﬁed by him/her.
Any additional requests for change or cancellation of an order may be sent by the Customer to the Provider at firstname.lastname@example.org . However, the Provider is not obliged to comply with such requests. Costs incurred to a Customer when using distance means of communication related to the conclusion of the Contract (costs of internet connection etc.) shall be borne by the Customer.
By sending the order, the Customer grants the Provider his/her consent to the processing of his/her personal data, which he/she completes for the purpose of making the order, according to Act. 101/2000 Coll., on the protection of personal data. The data will be processed solely for the purposes of performance of the Contract and provision of the Services, and only for the purpose of providing the Services is the Provider to transmit these data to third parties, but only to such third parties which ensure provision of the Services for the Provider. The Customer is entitled to withdraw consent to the processing of personal data at any time by a registered letter or an email with guaranteed electronic signature sent to the registered address or email address of the Provider.
The Contract is always governed by Czech law, and in the event of disputes, the Provider and the Customer negotiate within the jurisdiction of the courts in the Czech Republic.
In matters within these Terms and Conditions, the Contract and the related rights and obligations of the Provider and the Customer, in particular, the rights of defective performance, are governed by the relevant provisions of the law, i. e., in particular, the relevant provisions of Act. No. 89/2012 Coll., Civil Code.
